a Federal Trademark
A trademark is a name (or phrase), symbol or design
identifying and distinguishing a product from goods
and services provided by other companies.
Unlike registering your business name with the County
or State, the Federal Trademark offers you Nationwide
protection of your mark.
Well
known trademarks include the Nike "Swoosh",
the AT&T "blue planet" or the phrase
"I'm lovin' it"® from McDonald's.
Requirements for a Trademark
1. A Trademark must be distinctive.
2. A Trademark must not infringe on existing Trademarks.
Filing a Trademark
1. The first thing is to do a comprehensive search
to make sure your name or symbol is distinctive and
not already registered.
NOTE: Though you can do a free trademark search online,
a "comprehensive search" is much more thorough
and includes searching many other Federal, State and
Local databases for potential conflicts.
2. Complete the Federal Application for a Trademark
and forward to the US Patent and Trademark Office (USPTO)
with the $335 fee.
3. A trademark attorney at the USPTO will review
and either accept the Trademark Application or
reject it and return it for resubmission.
4. Once the Trademark Application is accepted, you
may use the ® symbol to identify your trademark as officially Registered.
