Non-Profit Corporation

A non-profit corporation is a corporation organized under State law for a specific purpose (charitable, religious, educational, scientific, literary, etc.) to benefit a class of people.

How do I form a Non-Profit corporation?

At a minimum:

  1. You must form a non-profit corporation in your home State.
  2. Then you must adopt bylaws and obtain an FEIN.
  3. Finally, you must apply to the IRS for 501(c)(3) Status by filing Form 1023 (assuming you want tax-exempt status and other benefits for your non-profit corporation) and submitting a fee of $150 or $500 to the IRS (fee varies depending on certain factors). NOTE: This process can take up to 6 months.

There are other complexities involved including properly setting up the Board of Directors and Officers, preparing the required budget, etc.  that can further complicate setting up the company.
